PUPPY PURCHASE CONTRACT

The following is a sample of the contract we use for all puppy "companion puppy" placements. Show and breeding contracts are similar, but will be adjusted for individual cases. Changes can be made to the contract that are not reflected on this site, always read a contract fully and completely and discuss any question you have BEFORE signing.

Please read it carefully and be sure you are prepared to honour the contract in full before contacting us about a puppy.

1. DESCRIPTION

The puppy sold pursuant to the terms of this agreement is as follows:

This puppy has limited registration with ISWS, any offspring from this puppy are not registerable. This puppy must be neutered or spayed prior to its 1 year birthday.

and is herein after referred to as the "puppy" and/or "Silken".

2. CONSIDERATION

The Silken, identified in Section 1, is sold for the total sum of $1000.00. (Prices may change without notice, this is a SAMPLE).

3. CONDITIONS

The Purchaser agrees to take the Silken to the Purchaser’s own licensed veterinarian within one week of purchase for a health check. If the veterinarian determines the puppy to be ill, or for any reason the puppy is unacceptable, Purchaser may return the puppy for a full refund.

The Purchaser will continue with the schedule of vaccinations as recommended by their veterinarian.

The Purchaser agrees to take good and proper care of the Silken and agrees that it will reside at the home of the Purchaser.

The Purchaser agrees that the Silken is not to be left in a backyard or kennel only.

The Purchaser agrees that they are not acting as an agent in the purchase of the Silken.

This Silken is sold with the understanding that the Purchaser avowed that the Silken would become part of the family.

The purchaser agrees NEVER to leave a choke chain type collar on the Silken when unsupervised.

The Silken will be given adequate shade, shelter and housing, have access to a fenced yard, and will be properly and sufficiently fed, while not being allowed to become obese. He will receive proper veterinary care throughout his lifetime, including annual (or as recommended) vaccinations and preventative health care.

The Silken shall not be mistreated or abused, be allowed to run loose, nor shall he be kept chained or tied, or allowed to ride in the back of an open pick-up truck (pursuant to the Motor Vehicle Act of BC), whether crated or not.

Under the terms of this contract, Tangaloor has the right to investigate the care of the Silken if circumstances warrant. If we feel the Silken is not getting proper care and treatment, we have the right to have the Silken examined by a licensed veterinarian mutually agreeable to the Purchaser and Breeder. If the veterinarian finds the dog has been mistreated or that the care of the dog has not been up to the standards of this contract, Tangaloor has the right to take full possession of the Silken, without compensation. Under such circumstances, all warranties are then VOID.

The Purchaser will spay/neuter* the Silken before the Silken reaches the age of 9 months and will provide certification of this to Tangaloor. *If the Purchaser has agreed to allow Tangaloor to show the Silken, this condition is waived until amended contract has been fulfilled.

Purchaser guarantees Tangaloor the right of first refusal if the Silken is to be sold or disposed of in any way. If Tangaloor does not wish to acquire the Silken, we will assist the Purchaser in placing the Silken. If we do take this Silken back for placement in another home, signed registration papers must accompany the Silken, and a suitable refund will be made upon placement of the dog, after we have deducted costs.

4. WARRANTY

Our first concern is for the well-being of our puppies throughout their lifetimes. Therefore, if - for any reason and at any time - you choose not to keep your Silken, return the Silken to us and we will refund the purchase price. A suitable deduction will be made to the refunded amount based upon the dog’s age, and if it has any preventable conditions, including but not limited to: obesity, signs of abuse, parasites, lack of basic training.

We have done everything possible to ensure that the puppies we breed do not carry life-threatening genetic defects. We have nevertheless decided on the following policy, should the unthinkable occur:

If the Silken’s owner (upon advice of a reputable veterinarian) determines that the Silken’s quality of life is seriously affected because of a genetic defect within the first four years of the Silken’s life, we provide the following options:

If the Silken is euthanized or returned to us, we will provide a replacement Silken as soon as one is available at no charge, OR refund the purchase price, at our discretion.

If the owner chooses to keep the Silken we may refund a portion of the purchase price.

This warranty expressly covers ONLY the refund or partial refund as listed, and does NOT cover costs of health care, treatments, or surgeries which Purchaser may elect to have done. If any problems do arise the Purchaser must notify Tangaloor immediately, prior to undertaking any treatment, unless an emergency situation.

Breeder has represented this Silken as companion quality, which means the Silken has minimal faults in structure, movement, or breed type, and/or has minor cosmetic faults at the time of sale. The Silken has been evaluated for temperament and raised in an environment to ensure a temperament suitable for this breed. Tangaloor therefore expects the Purchaser to properly raise and train this Silken, ensuring good socialization is completed.

5. FURTHER CONDITIONS

Breeder and Purchaser agree to stay in contact with each other and keep each other apprised of any change of circumstances, address, or telephone number. Breeder agrees to be accessible to Purchaser and to help solve any problems and answer any questions the Purchaser may have in the raising and training of this Silken.

The new owner is respoonsible for having their Silken neuteredor spayed as part of fufilling this agreement. Since this animal was sold as companion quality and not as breeding quality, it has been assigned limited registration with the International Silken Windhound Society. Any offspring resulting from this puppy are unregisterable and will void the agreement between Buyer and seller and gives the seller right to respossess said dog and its offspring.

Violations of the terms of this contract render all guarantees stipulated in this contract to be null and void and may result in the Purchaser being required to return the Silken to the Breeder within five days of receipt of notice from Tangaloor. The Purchaser will be responsible for the cost of the Silken's transport back to Tangaloor. If the Purchaser violates this agreement, they will be responsible for any and all legal costs Tangaloor incurs enforcing this contract.

PURCHASER HAS READ AND UNDERSTANDS THE FOREGOING AND AGREES THAT ALL PARTS AND PORTIONS THEREOF CONSTITUTE A BINDING AGREEMENT. THIS CONTRACT CONSTITUTES THE ENTIRE AGREEMENT OF BOTH PARTIES WITH RESPECT TO THE SALE MENTIONED ABOVE. NO PART OF THIS CONTRACTUAL AGREEMENT IS TRANSFERABLE. FURTHER, SIGNATURES BELOW ACKNOWLEDGE RECEIPT OF A COPY OF THIS CONTRACT BY PURCHASER.
